Plus de petits nounours au champagne !

Une jolie victoire pour la Champagne et son appellation.  En septembre 2017, puis en janvier 2018, le Comité Champagne est averti de deux demandes d’enregistrement pour la marque « Champagne Bears » en Turquie, la première pour des bonbons, ( des petits nounours gélifiés)  la seconde pour des cosmétiques.

Après oppositions formées contre ces deux demandes par le Comité Champagne et l’INAO, l’office de la propriété intellectuelle turc a refusé l’enregistrement de ces marques au motif qu’elles consistent exclusivement ou comprennent une indication géographique enregistrée.

Il s’agit donc des premières décisions de l’office sur oppositions formées par le Comité Champagne et l’INAO suite à l’enregistrement de l’appellation Champagne obtenue le 30 mars 2017.

Ces décisions ne manqueront pas de renforcer la position du Comité Champagne dans le cadre des autres actions initiées contre les usages et marques détournant le nom Champagne. Le Comité Champagne est chargé de combattre les contrefaçons et de s’opposer aux utilisations abusives de l’appellation d’origine contrôlée Champagne (usurpations). Dans certains pays, le Comité Champagne intervient également pour reconquérir la distinctivité de l’appellation (usurpations légalisées)

Par ailleurs, dans les pays où la protection de l’appellation n’est pas assurée, le Comité travaille aux côtés des administrations françaises et européennes à l’amélioration de la protection de l’appellation Champagne.

Victory for Champagne In September 2017, and again in January 2018, the Champagne Committee is notified of two registration applications for the « Champagne Bears » brand in Turkey, the first for sweets (gummy little teddies) and the second for cosmetics. After opposing these two applications by the Comité Champagne and the INAO, the Turkish Intellectual Property Office refused to register these marks on the grounds that they consist exclusively or include a registered geographical indication. It is therefore the first decisions of the office on oppositions formed by the Comité Champagne and the INAO following the registration of the Champagne appellation obtained on March 30, 2017. These decisions will not fail to strengthen the position of the Champagne Committee in the context of other actions initiated against the uses and brands diverting the name Champagne. The Comité Champagneis responsible for combating counterfeiting and opposing abusive uses of the controlled label of origin Champagne (usurpations). In some countries, The Comité Champagne  also intervenes to regain the distinctiveness of the appellation (legalized usurpations) Moreover, in countries where the protection of the appellation is not ensured, the Committee works alongside the French and European administrations to improve the protection of the Champagne appellation.
